1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of Sankorra's platform, software, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.
If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
2. Description of Services
Sankorra provides a cloud-based software platform designed for death care facilities, including funeral homes, mortuaries, crematoria, and cemeteries. Our Services include case management, workflow automation, document storage, compliance tracking, and related features.
3. Account Registration
To use our Services, you must:
- Register for an account with accurate and complete information
- Maintain the security of your account credentials
- Promptly notify us of any unauthorized access
- Be at least 18 years of age
- Have the legal authority to enter into these Terms
You are responsible for all activities that occur under your account.
4. Subscription and Payments
4.1 Subscription Plans
Access to our Services requires a paid subscription. Current pricing and plan details are available on our website. We reserve the right to modify pricing with 30 days' notice.
4.2 Billing
Subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except as expressly provided in these Terms or required by law.
4.3 Free Trials
We may offer free trials. At the end of a trial period, your account will automatically convert to a paid subscription unless you cancel before the trial ends.
5. Your Data
5.1 Ownership
You retain all rights to the data you upload to or create within the Services ("Your Data"). We do not claim ownership of Your Data.
5.2 License to Us
You grant us a limited license to use Your Data solely to provide and improve the Services. This license includes the right to store, process, and display Your Data as necessary to operate the platform.
5.3 Your Responsibilities
You are responsible for the accuracy, quality, and legality of Your Data and for ensuring you have the necessary rights to use and share it through our Services.
6. Acceptable Use
You agree not to:
- Violate any applicable laws or regulations
- Infringe on the rights of others
- Upload malicious code or interfere with the Services
- Attempt to gain unauthorized access to our systems
- Reverse engineer or decompile the software
- Use the Services for any illegal purpose
- Share your account credentials with others
- Resell or redistribute the Services without authorization
7. Intellectual Property
The Services, including all software, designs, text, graphics, and other content (excluding Your Data), are owned by Sankorra or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Services in accordance with these Terms.
8. Confidentiality
We will maintain the confidentiality of Your Data in accordance with our Privacy Policy and industry standards. You agree to maintain the confidentiality of any non-public information about our Services or business that you may receive.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SANKORRA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to indemnify, defend, and hold harmless Sankorra and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Services, violation of these Terms, or infringement of any rights of another party.
11. Termination
Either party may terminate this agreement at any time. You may cancel your subscription through your account settings. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the Services will immediately cease.
You may request export of Your Data for up to 30 days after termination.
12. Changes to Terms
We may modify these Terms at any time. We will provide notice of material changes by email or through the Services. Your continued use of the Services after changes become effective constitutes acceptance of the modified Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Ghana, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the competent courts of Ghana.
